This privacy notice will tell you about your privacy rights, how the law protects you and how we look after your personal data when you visit our website and/or use our online services.

This privacy notice aims to give you information on how we collect and processes your personal data through your use of this website, including any data you may provide through this website when you sign up or purchase a product or service.

You have the right to make a complaint and we ask you contact the Data Controller above. If our Data Controller cannot resolve your concern you have the right to make a formal complaint to the Information Commissioners Office (ICO) at www.ico.org.
The data we collect about you.
Some of our clients are sole traders and some clients are registered businesses. However, the information we collect is required in order to fulfil our legal obligations and to fulfil our contract with you.
- Personal Data
We store the first name, surname, mobile number and email address of the person responsible for your MOT Manager system - normally the garage owner or Director. This is to provide our contractual obligations to you. - Company Data
We store your company name, address, postcode, business telephone numbers and email address. - Payment Information
For online payments, we use a third party payment gateway, Worldpay. Worldpay have their own privacy policy (https://www.worldpay.com/uk/worldpay-privacy-notice) and you should be aware of how they process personal data when making a purchase. Once a successful purchase is made, Worldpay securely provide the name, billing address, IP address and payment details of the purchaser electronically via HTTPS. We do not store any credit card information provided to Worldpay. - Usage Data
While using the MOT Manager system. we store the pages you visit and vehicles entered to provide a usage history for your own record. - Marketing, Information & Communication Data
We base our communications on "legitimate interest" and only send communications to customers with whom we have a contract and a business relationship. We may send information to you periodically and our communications will always be regarding the MOT Manager system or to provide information which will relate to or where we believe it will be of genuine interest to your business. You may opt out at any time.
We do not store any Special Category data, such as race or religious beliefs.
How we collect your personal data.
The personal data we collect is by way of a contract you complete on applying for our service or by providing information when asked as required to fulfil our obligations to you.
We also collect partial personal data of the person making a payment via Worlpday, our payment gateway. Please read "Payment Information" in the category above for further information.
You have a responsibility to keep your data up to date.
It is important that you keep your data up to date and accurate. Should your personal data change during your relationship with us, you should inform us as early as possible so we can update the records.
How we use your personal data.
We only use your personal data as permitted by Law. We would only share your personal data where required to do so to comply with a legal or regulatory obligation and do not share data with 3rd parties unless to fulfil a legal obligation.
The purpose for holding your personal data.
- To enter into a contract with you/your company.
- To manage and document payments for services or products as required for our legal obligations.
- To recommend services or products that we offer or may offer that may be of interest to you.
- To notify you of changes to the service we provide, updates to our terms & conditions or privacy information or to contact you if any fees are payable.
Altering the purpose for which we hold your data.
We only intend to use your data as specified in this privacy policy. If, in the future, we need to use your data for any other purpose you would be notified and where applicable able to opt out or terminate your contract with us.
Disclosure of your personal data.
- We will only share your personal data as required to fulfil our legal obligations - for example to HM Revenue & Customs or Service Regulators. In all cases you will be informed in writing prior to any data being released.
- We do not share data with 3rd party companies other than to fulfil our legal obligations.
- Your data will not be transferred outside of the EU unless to fulfil our legal obligations.
Who within our company has access to your personal data.
We need to process your personal data in order to provide a continued service to you and fulfil our contractual obligations and maintain our high standard of service. From time to time our staff may need to contact you and they have access to your name and contact information (including mobile number, business telephone numbers and email address) and business address. All our staff have a duty of confidentiality. If you do not wish our staff to have access to your personal data, please notify us. However, removing access rights may adversely affect the quality of service we offer to you or make providing the service impossible.
Data security.
Your data is stored on secure servers to prevent personal data from being accessed by unauthorised persons. Personal data and passwords are encrypted before being stored. As required by Law, we have measures in place to ensure you and any regulator is informed of a suspected personal data breach.
Retention of Personal Data.
We only retain personal data as long as is absolutely necessary and for the purpose in which we collected it. You have a right to data erasure and where applicable, except to maintain personal data to fulfil our legal obligations, personal data will be deleted when no longer required for lawful processing.
Your legal rights.
You have a right to:
- Request Access to your personal data (data subject access request)
- Request Erasure of your personal data
- Request Correction of your personal data
- Restrict Processing or Object To Processing of your personal data
- Withdraw Consent to Processing.
To access your personal data, you will not have to pay a fee unless your request is excessive or unfounded. Any fee charged will be reasonable. Withdrawing or restricting consent may adversely affect the services we provide or may mean we can no longer offer our services to you. Contractual obligations will still apply.
Before disclosing or making changes to your personal data, we may need to validate your identity by asking for additional information from you.
We aim to respond to any request within 28 days. If this time is not enough we will notify you in writing and explain why.
We are also a Third Party Data Controller.
We act as a joint Third Party Data Controller to handle or store data on your behalf. As a user of MOT Manager, in order to use our service to create and send reminders or book in vehicles into our system it is necessary for us to store some personal data on behalf of your company provided by your own clients.
However, some data entered into our system is not defined as personal data. For example, to create an SMS reminder for an MOT expiry, a mobile number and registration number is required. However these together do not identify an individual. However, including their name to make the message more personal makes this data personal data. In all cases, all data records entered into MOT Manager are encrypted.
You must decide carefully who has access to your MOT Manager account within your organisation. You should change your password regularly and ensure that nobody apart from authorised persons within your company can access or view data records.
You must also have your own privacy policy in place to provide transparency for your customers. This privacy policy applies to our business relationship with you and does not extend to any third party.
Sharing of Third Party Data.
We do not share your customer data unless required to do so to comply with our legal obligations.
